Terms and Conditions (T&C)

1. Scope
These Terms and Conditions (T&C) apply to all offers, services, and contracts between Qualibration – Kerstin Mahlmann, Leitermayergasse 28/27, 1180 Vienna, Austria (hereinafter referred to as “Qualibration”) and its clients. Any differing conditions from clients will not be recognized unless expressly confirmed in writing by Qualibration.
2. Services
Qualibration offers training, movement, and coaching sessions in the fields of sports, health, and body awareness. The offer includes, in particular, group classes, individual sessions, monthly subscriptions, and multi-session cards (5, 10, or 20 sessions). Changes to programs, schedules, or training venues may occur.
3. Contract conclusion
A contract is concluded by:
- the client’s registration (verbally, in writing, or online), and
- confirmation by Qualibration.
By registering, clients accept these T&C.
4. Participation requirements
Participation takes place at the client’s own risk. Clients are required to inform Qualibration of any health issues or restrictions before beginning a session. Qualibration assumes no liability for pre-existing health risks known to participants before the start of training.
5. Payment terms
- Course fees must be paid in advance.
- Monthly subscriptions must be paid in full before the first session.
- Multi-session cards (5, 10, 20 sessions) are valid for one year from the date of purchase and must be paid in full before the first session. Unused sessions expire after the validity period. Refunds or transfers to other persons are excluded, unless expressly agreed otherwise.
6. Cancellations, terminations, and absences
- Single class bookings can be cancelled free of charge up to 24 hours before the session. In case of later cancellations or no-shows, the full fee will be charged.
- Monthly subscriptions are automatically renewed for one additional month unless cancelled in writing (e.g. by email) at least 14 days before the end of the current month. If no timely cancellation is received, the subscription fee becomes automatically due.
- If a session has to be cancelled by Qualibration (e.g. illness, force majeure), a replacement date will be offered or the fee will be credited proportionally.
7. Liability
Qualibration is only liable for damages caused intentionally or by gross negligence. Further liability, especially for accidents or injuries during classes, is excluded. Clients are responsible for their own insurance (accident, health, or liability insurance).
8. Data protection
All personal data is treated confidentially and in accordance with applicable data protection laws. Details can be found in the privacy policy on www.qualibration.at.
9. Right of withdrawal (for online bookings)
If the contract is concluded online or via distance communication, the statutory right of withdrawal of 14 days applies in accordance with the Austrian Distance Selling Act (FAGG).
To exercise the right of withdrawal, clients must inform Qualibration by means of a clear statement (e.g. email) of their decision to withdraw from the contract.
10. Final provisions
Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected.
Austrian law applies. The place of jurisdiction is Vienna, unless a mandatory statutory place of jurisdiction for consumers applies.
